Welcome to the website for the Cassi Miami residential rental project.  This website (www.cassimiami.com) is owned and operated by Design District Associates, LLC, with its subsidiaries and affiliates,  (the “Company”), and is being provided for preliminary information purposes only.  This website is meant to be used as an overview of the Cassi Miami residential rental project (the “Project”), and in no way whatsoever should the information contained in herein be relied on for financial, tax, accounting, investment, business or legal advice.  All items are subject to modification, change and/or being withdrawn at any time in the sole discretion of the Company.   Your use of this website constitutes your binding acceptance of these terms.  If you do not wish to be bound by the terms, you may not access or use this website.  

1. User Account.  Depending on the services or data you seek access to on this website, the Company  may request that you register and set up an account with/without a password (“Account”).  You agree and acknowledge that you will not allow others to utilize your Account and that you will not disclose your password to anyone.  You are responsible for maintaining the confidentiality of your password and Account, and are fully responsible for all activities that occur under your password and account.  The Company cannot and will not be liable for any loss or damage arising from your failure to comply with this provision.  The Company may terminate your Account and suspend your use of the website for any reason or no reason, without prior notice to you, including, but not limited to, if Company suspects that your Account is being used in an unauthorized manner.

2. IP Property Rights.  You acknowledge and agree that content or information presented to you in the website may be protected by copyright, trademark, or patent law, or other proprietary rights and laws.  You agree not to modify, distribute, copy, reproduce, or create derivative works from any material contained within the website unless the prior written permission of Company has been obtained.

3. Use Restrictions. In accessing the website and services therein, you agree not to:

3.1 use, copy, modify, adapt, correct errors or create derivative works from the website or any component thereof, or use the website to create a competing system;

3.2 decode, reverse engineer, disassemble, decompile or otherwise translate or convert the website or any component thereof;

3.3 publicize or otherwise advertise the use of the website or the content therein, without the prior written consent of Company;

3.4 use the website, or any content, for any business decisions or commercial purpose, such as promotion or sale of your products or services; or

4.1 Some links within the Company website may lead to other sites owned and operated by third parties.  Company is not responsible for their content and does not necessarily sponsor, endorse or otherwise approve of the materials appearing in such sites. In addition, linked sites may be subject to terms of use and/or privacy policies of their owner/operators, and anyone who uses such a link is responsible for checking what those terms/policies are for themselves.  

4.2 To the extent any portion of the website contains opinions provided by third parties, such opinions are the opinions of the individual author and may not reflect the opinions of the Company or any of its employees. Company is not responsible for their content and does not necessarily sponsor, endorse or otherwise approve of the materials provided by third parties.

5.1 Privacy Policy.  Use of the website shall by governed by the Company’s Privacy Policy located at www.cassimiami.com. Company reserves the right at all times to monitor, review, retain and/or disclose any information, including IP addresses, as necessary to satisfy any applicable law, regulation, legal process or government request, or to cooperate with law enforcement and other authorities in investigating a claim of illegal activity.

ALL DRAWINGS ARE CONCEPTUAL RENDERINGS AND THE DEVELOPER EXPRESSLY RESERVES THE RIGHT TO MAKE MODIFICATIONS. ACTUAL VIEWS MAY VARY AND CANNOT BE GUARANTEED. PLEASE REFER TO THE DEVELOPER’S OFFICIAL PROJECT BROCHURES, WEBSITE AND MATERIALS AND THE DOCUMENTS FURNISHED BY THE DEVELOPER PURSUANT TO STATE LAW FOR INFORMATION REGARDING THE PROJECT.

8. Indemnification.  You agree to indemnify and hold harmless Company, and its subsidiaries, affiliates, officers, agents or other partners, and employees, from any claim or demand, including reasonable attorneys’ fees, made by any third party due to or arising out of your use of and access to the website and services therein, Your violation of these terms and conditions, your violation of any rights of a third party, including, but not limited to, claims of: infringement of third party intellectual property rights or rights of privacy and publicity, claims of defamation, as well as your violation of any applicable laws or regulations.

9. Fair Housing/Equal Housing Opportunity.  Design District Associates, LLC, is an Equal Housing Opportunity company, which means regarding the Project, Design District Associates, LLC (as well as all of our affiliated entities and employees) shall comply with the Fair Housing Act and other applicable federal, state and local anti-housing discrimination laws. The federal Fair Housing Act prohibits discrimination in housing because of: Race, Color, National Origin, Religion, Sex, Familial Status, Disability.   If there are any additional state or local jurisdictions which have additional fair housing laws and more protected classes, Design District Associates, LLC is responsible for complying with those laws and regulations as well.

All rental properties identified in the Project are subject to the federal Fair Housing Act and its state law counterparts. Design District Associates, LLC will not knowingly permit or allow any discriminatory conduct in the rental of its properties that violates applicable law. Complaints concerning discriminatory practices in housing may be filed with the local office of the U.S. Department of Housing and Urban Development (“HUD”) or by calling HUD toll free at 800-669-9777 (voice) or 800-927-9275 (TDD). HUD maintains extensive fair housing information on the internet which can be accessed on the internet at http://portal.hud.gov/hudportal/HUD?src=/program_offices/fair_housing_equal_opp/FHLwas.  

10. General.  These terms and conditions will be governed by and construed in accordance with the laws of the State of Florida, and any disputes arising hereunder shall be subject to the exclusive jurisdiction of the courts of Miami Dade County, Florida.  Company may revise these terms and conditions from time to time by updating or revising this posting, with the revised terms and conditions taking effect as of the date of its posting. It is your responsibility to check these terms and conditions periodically for changes. Your continued use of the website following the posting of changes on the website will mean that you accept and agree to the changes.
